Article 1 (Purpose)
These Terms govern the conditions, procedures, and rights and obligations between DAYLAB (“Company”) and users of the mentalog service (“Service”).
Article 2 (Definitions)
- Service: The mentalog mobile application and related web services provided by the Company
- User: Any person who agrees to these Terms and uses the Service
- Check-in: The act of recording mood, emotions, conditions, activities, etc. within the Service
- Premium: Additional features available through paid subscription
Article 3 (Effect and Amendment)
- These Terms take effect when posted on the Service or otherwise communicated to users.
- The Company may amend these Terms within the scope permitted by law, with at least 7 days' prior notice before the effective date. For material changes (pricing, core features, etc.), we will provide at least 30 days' notice.
- Users who do not agree to the amended Terms may discontinue use and delete their account.
Article 4 (Registration and Accounts)
- Users may register via Google or Apple sign-in.
- Users must provide accurate information and must not impersonate others.
- Accounts are for personal use only and may not be transferred or shared.
- You must be at least 14 years old (Korea), 13 years old (USA/COPPA), or 16 years old (EU/GDPR, varies by member state) to use the Service. If we become aware that a user is under the applicable minimum age, we will immediately delete their account and data.
Article 5 (Service Description)
A. Free Service
- Mood check-in (5-level mood + emotion/condition/activity tags + short memo)
- Mood calendar
- Basic report (after 7+ days of records)
- Basic CSV data export (data portability right)
- Includes advertisements
B. Premium Service (Paid)
- Ad-free experience
- Detailed pattern analysis
- Clinical PDF report generation
- Advanced data export (including reports)
Article 6 (Paid Service and Billing)
- Premium is offered as monthly ($4.99/mo) or annual ($34.99/yr) subscriptions.
- Payments are processed through Apple App Store or Google Play Store in-app purchases.
- Subscriptions auto-renew unless cancelled. If subscription pricing changes, we will notify you at least 30 days before the renewal date via email or in-app notice.
- Cancellation is available through your device's subscription management settings.
Article 7 (Refund Policy)
- Refunds for in-app subscriptions are subject to Apple App Store and Google Play Store refund policies.
- Refund requests are handled directly through each store:
- Apple: Settings → Apple ID → Subscriptions → mentalog
- Google: Play Store → Payments & subscriptions → Subscriptions → mentalog
- If you cancel after subscribing, you may continue to use Premium features until the end of the current billing cycle. No partial refunds are provided for the remaining period.
Article 8 (User Obligations)
Users must not:
- Use another person's account without authorization
- Use the Service in violation of laws or public morals
- Interfere with stable service operation (hacking, reverse engineering, etc.)
- Use the Service for unauthorized commercial purposes
Article 9 (Service Interruption and Changes)
- The Company may temporarily suspend the Service for system maintenance or equipment replacement.
- The Company may modify or terminate the Service with at least 30 days' prior notice to users.
- In the event of service termination, users may export their data in CSV format from within the app until the termination date. Any remaining data will be permanently deleted within 30 days after termination.
Article 10 (Medical Disclaimer)
- PHQ-9, GAD-7, and ASRM scores provided by the Service are statistical estimates based on check-in data and are not medical diagnoses.
- The Service is not a medical service and does not replace professional medical advice.
- For accurate diagnosis and treatment of mental health conditions, please consult a qualified healthcare provider.
- In a crisis, please contact: Korea 1393 (24hr), USA 988 Suicide & Crisis Lifeline, or your local emergency services.
Article 11 (Intellectual Property)
- Intellectual property rights in the Service's design, code, and content belong to the Company.
- Ownership of check-in data entered by users belongs to the users.
Article 12 (Limitation of Liability)
- The Company is not liable for service unavailability due to force majeure (natural disasters, war, etc.).
- The Company is not liable for service disruptions caused by the user's own actions.
- The Company does not guarantee any specific outcomes (mood improvement, etc.) from using the Service.
- In the event of damages caused by the Company's willful misconduct or gross negligence, the Company's liability shall be limited to the service fees paid by the affected user during the preceding 12 months. This limitation does not apply where prohibited by applicable law.
Article 13 (Account Deletion)
- Users may delete their account at any time via Settings → Delete Account.
- Upon deletion, all personal information and check-in data are immediately and permanently deleted.
- Active subscribers should cancel their subscription through the app store before deleting their account.
Article 14 (Governing Law and Disputes)
- These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
- In the event of a dispute, the Company and users will attempt to resolve it amicably through good-faith negotiation.
- If negotiation fails, the Seoul Central District Court shall have exclusive jurisdiction as the court of first instance. However, for EEA residents, the GDPR shall prevail to the extent applicable, and for California residents, the CCPA shall prevail to the extent applicable.
